January Court 1799. Agreeable to an order of Caswell Court, October Term 1798. To us directed to divide and lott off the slaves belonging to Richard Brooks deceased between the legatees of the said deceased, we the subscriers have this 14 day of November 1798 proceeded to have and lott off the said slaves as followeth: To Ann Brooks Tom & MIlly £150, To William B. Brooks Riner & Sanco £105. To James Sheppard in right of his wife Frances, Sarah Poll & James at £90 and to John Brooks Evan & Hannah at £105. 2.     November 22, 1798 (Caswell County Will Book D p. 162, familysearch # 87)

Ordered that Thomas Johnston, Bartlett Estridge, Joseph Chandler, Thomas Kimbrough, Alexander Murphy, Robert Martin, Richard Martin, Barzilla Graves, Graves Howard, Richard Cochran, Joseph Bush, John Graves, Jr., John Graves, Sr., James Williamson, La__ Johnston, John Henslee, John Barker, David Barker, john Kerr, John Payne, Francis Smith, Harvey Willis, Humphrey Roberts, Thomas Slade, William Slade and Lewis Shepard be a jury or any twelve of them to view and lay off the road from Caswell Court House by John Graves mill and from thence to the Hillborough Road at or near William Brooks and report their proceedings to our next court.

Note: This is the present day Marshal Graves Road and its connection to the Badgett Sisters Parkway.

Note: Richard Martin (d. 1841) was the son of Richard and Anthorite (d. after 1801) Martin. He and his brother Robert (1756-1837) both fought in the Revolutionary War as privates.

5.     April 29, 1799 (Civil Action Papers, Caswell County,1799-1800)

To the Sheriff of Caswell County greeting. You are hereby commanded to take the body of Lewis Shepard (if to be found in your bailwork) and him safely keep so that you have him before the Justices of our County Court  of pleas and quarter sessions to be held for the County of Caswell on the fourth Monday of July next to answer Thomas Robinson of the plea of trespass on the case damage fifty pounds current money of the state. (Recorded by Archibald Murphey Clerk of Court on the 4^th Monday of April 1799)

6.     July 12, 1799 (Civil Action Papers, Caswell County,1799-1800)

Know all men by these presents that we Lewis Sheppard and Azariah Gray, Esq. all of the County of Caswell and the State of North Carolina are held and firmly bound unto James Williamson Sheriff of said County in the just and full sum five hundred pounds to which payments well and truly to be made and done we bind each of our selves and each of our heirs, assigners, etc. jointly personally and firmly by these presents sealed with our seals and dated this 12^th day of July 1799. The condition of the  above obligation is such that  if the above bound Lewis Shepperd __ and shall make his personal appearance at the Court House of Caswell on the fourth Monday of July then and there to answer Thos. Robinson of the offence of trespass on the case to his damage one hundred pounds the above obligation to be void otherwise to remain in full force and effect in law. 7.     July 24, 1799 (Civil Action Papers, Caswell County, 1793-1799)

To the Sheriff of Caswell County greeting. You are hereby commanded to take the body of Richard Johnson…before the justice of our County Court…on the fourth Monday of October next to answer Lewis Sheppard of a plea of trespass on the case of damage one hundred pounds current money.

Ordered that Robert Shy be appointed overseer of the road to open and keep in repair the road from Joseph Chandlers Pathe above William Brownings leading by his shop and thence by Bartlett Estridges field on the Main Road near Thomas Johnstons with the following hands to work thereon, to wit, Joseph Chandlers hands, John Pinson, Lewis Shepard, Maeajah Estridge, Bartlett Estridge, Thomas Johnston, widow Brooks hands, James Shepard, Nathanel Rice, widow Pyrants hands, Robert Thompson, Anderson Williams, William Stade.

9.     October 17, 1799 (Civil Action Papers, Caswell County, 1793-1799 #967)

        October 17, 1799. Know by these presents that we Richard Johnson, Thomas Jackson and Booth Jackson of the county of Caswell are bound unto William Muzzall Sheriff of the county of Caswell in the sum of 200 pounds…The condition of the above obligation such that the above Richard Johnson shall make his personal appearance at our County Court of Pleas and Quarter Sessions… on the fourth Monday in October and answer Lewis Shapard damage his suit brought against him on write of case…

I William Muzzall Sheriff of the County of Caswell do hereby assign the within obligation and condition to Lewis Shepperd the within named his executor admin.                 Sophia Shapard was born in Caswell County, North Carolina. Child of Lewis and Martha

13.   1800 (Caswell County North Carolina County Tax List, 1777-1867, Family History Library, p. 414)

Lewis Shapard is listed in St. David District with 400 acres, one white pole and 6 black poles

Note: By this account, Lewis had sold his 365 acres in the Richmond District between 1798 and 1800 and had made his residence in the St. David District. Anderson Williams was in St. Davids District with 410 acres, 1 white pole, 3 black poles and no stud horses.

14.   1800 (Census of Caswell County North Carolina within the Hillsboro District, page 30 of 56)

Lewis Shepperd is listed as a white male between the age of 26-45 and having one white male under 10 years old (William), one white male between 16 – 26 years old (Booker?), four white females under the age of 10 (Sophia, Sallie, Polly and Elizabeth), one white female between the age of 26-45 (Martha) and having 8 slaves.

Note: the Hillsboro district was a military district that included a large portion of North Carolina. In the census Lewis is listed around the names of James Lewis, James Shelton, John Gooloe, Richard Eastice, James Turner, Lewis Sheppard, Anderson Williams, Thomas Bowman.

15.   1800 (Deed Book M, p. 234). State of North Carolina to William Estes, 33 ½ acres on waters of Country Line Creek. Beginning at turkey oak in his line south with William Gooch line 28 Ch to pointers, thence with William Slade line west 12 Ch to black jack, thence with his own line north 28 Ch to post oak, thence with his own line east 12 Ch to beginning.

Note: William Fitch (Fitz) married Lydia Stadler (any relation to Abraham Statler in Murfreesboro?)

Note: The "Bastardy Bonds". In early North Carolina, when a single woman became pregnant or birthed a child out of wedlock a warrant was issued for the woman to appear in court. Under oath she was asked to name the child's father. The father was then served a warrant and required to post bond to support the child, so the child would not be a financial burden on the state. The court would collect the judgement amount from the father, often borrowing the funds from his bondsmen as security. Sometimes the woman risked incarceration by refusing to name, the father; however, she, her father or some other interested party could post the bond to prevent her from going to jail.

17.   January 27, 1800 (Civil Action Papers, Caswell County,1799-1800)

State of North Carolina, to the Sheriff of Caswell County  greeting. You are hereby commanded to take the body of Joshua Hudson (If he be found in your bail work) and him safely keep so that you have him before the Justices of our County Court of Pleas and quarterly session to be held for the County of Caswell on the fourth Monday of April next to answer Lewis Sheppard assignee of William Smith, a plea which he renders unto him the sum of fifty pounds which to him he owes and from him detains – damage fifty pounds. Herein fail you not – witness, Archibald Murphy Clerk of said Court at office the fourth Monday of January in the XXIVth year of our independence A. Dom. 1800.

18.   January 29, 1800 (Caswell County Court Minutes, Family Search, p 412)

The State vs. Robert Kimbrough. The following jury sworn, to wit, …Lewis Shapard… who find the defendant guilty..fined £5 and costs.

19.   February 8, 1800 (Civil Action Papers, Caswell County,1799-1800)

Know by all men these presents that we William B. Brooks and Lews Sheppard all of the County of Caswell and the State of North Carolina are held and firmly bound unto William Muzzall High Sheriff of said County in the just and ___ sum of five hundered pounds to which payment well and truly to be  made and done we bind each of our selves each of our heirs executors, etc. jointly and severally and firmly by these presents sealed with our seal and dated this 8^th day of February 1800. The condition of the above obligation is such that if the above bounden William B. Brooks do and shalt make his personal appearance at the Court House of Caswell County on the fourth Monday of April next then and there to answer George Shelton of a plea of debt due him to the amount of three hundred and twenty five dollars with interest therin from the 30^th of June last then the above obligation to be void otherwise to be in full force and effect in the law. 20.   March 24, 1800 (Civil Action Papers, Caswell County,1799-1800)

Know all men by these presents that we Lewis Sheppard and John Yancy are held and firmly bound unto Joshua Hudson in the just and full sum of fifty pounds to be paid to the said Joshus Hudson his heirs, executors and administrators  to the which payment is well and truly to be made we bind ourselves our heirs, executors and administrators joinally and severally and firmly by these presents sealed with our seals and dated the 24^th day of March 1800. The condition of the above obligation is such that whereas the above bound Lewis Sheppard hath obtained a writ against the body of Joshua Hudson for debt if therefore these shall above bound in Lewis Sheppard doth will and truly prosecute his said suit with effect or in case he fail therein shall well and truly pay all costs and damages that shall be awarded thereon then the above obligation shall be void otherwise to remain in full force and effect. 21.   April 1, 1800 (Civil Action Papers, Caswell County,1799-1800)

Know all men by these presents that we Joshua Hudson and John Yancy all of the county of Caswell and State of North Carolina are held and firmly bound unto William Muzzal Sheriff of the County aforesaid, in the sum of  two hundred pounds to be paid to the said William Muzzall his heirs executors and to which payment well and truly to be made we bind ourselves and each of us our heirs, executors and administrators and ___ of them jointly and severally to these presents sealed with our seals and dated this 1^st day of April, 1800.

                The condition of the above obligation is such that if the above bounded Joshua Hudson shall make his personal appearance at our County Court of Pleas and quarter sessions to be held on the fourth Monday in April and answer Lewis Shepperd in his suit brought against him on writ of debts damage one hundred pounds and well and truly abide the judgment sentence and desire of the said Court that then the above obligation shall be void otherwise to remain in full force and effect. Sherriff of Caswell County greeting, you are hereby commanded to take the body of Sarah Smith (if to be found in your bail work) and her safely keep so that you have her before the Justices of our County Court of Pleas and Quarter Sessions to be held for the County of Caswell on the forth Monday of April next to answer Lucy Smith of a plea of trespass assault and battery and false imprisonment to her damage of five hundred pounds (dated forth Monday in January 1800).

Caswell County Civil Action Papers #886. Know all men by thses presents that we James Burk, Jr and ___ next friend to Lucy Smith __ are held and firmly bound unto Sally Smith 100 pounds …dated July 29, 1800…condition whereas this day James Burke Jr. hath obtained a writ against the body of Lucy Smith for a plea of Trespass assault and batter and false imprisionment..therfore if the said James Burke Jr. shall prosecute his suit with effect or in case he fail therein do well and pay all cost and charges therein…

Know all men by these presents that we Lewis Sheppard and Thos. Compton are held and firmly bound unto Admiral White and Elyah Brown the full sum of fifty pounds the the said White and Brown their heirs, etc. To which payment is well and truly to be made we bind  ourselves our heirs, executors and administrators jointly seperatly and firmly by these presents sealed with our seals and dated the 22 nd day of May A. Domini 1800. The condition of the above obligation is such that whereas the above bounden Lewis Sheppard hath obtained a writ against the bodies of Admiral White and Elyah Brown – If therefore said Sheppard shall well and truly prosecute his suit with effect or in case he fails therein shall pay all costs and damages that shall be awarded thereon then the above obligation shall be void otherwise to remain in full force and effect. Know all men by these presents that we Francis Smith & Lewis Sheppard are held and firmly bound unto Thos. Polich the just and full sum of thirty pounds to be paid to the said Thos. Polich his heirs and assigners to which payment is well and truly to be made we bind ourselves our heirs, executors and administrators jointly and seperatly ad firmly by these presents sealed with our seals and dated the 3^rd day of July A. Domino 1800. The condition of the above obligation is such that whereas the above bound in Frances Smith hath obtained a writ against the body of Thomas Potich. If therefore the said Francis Smith doth well and truly prosecute his said suit with effects or in case he fail therein shall well and truly pay all costs and damages that shall be awarded thereon – then the above obligation shall be void otherwise to remain in full force and effect. 29.    July 28, 1800 (Civil Action Papers, Caswell County,1799-1800)

State of North Carolina, To the Sheriff of Caswell County greeting. You are hereby commanded to take the body of Admiral White and Elyah Brown (if to be found in your County) and them safely keep so that you have them before the justices of our County Court of Pleas and Quarter sessions to be held for the County of Caswell on the fourth Monday of October next to answer Lewis Sheppard assignee of Richard Simpson of a plea which they render unto him the sum of forty six pounds, which to him they owe and from him d____ damages twenty five pounds.  Herein fail you not and have you then and there this ___ Witness, Archebold Murphey Clerk of our said Court at office the fourth Monday of July on the 25^th year of our Independence A. Domini 1800.

Thomas Robinson vs. Lewis Sheppard. Case. (jury list) who find that the defendant did assume and did assume within three years, no satisfaction or settlement offers and assess the plaintiffs damages to £12 and costs.

John Wilson vs. Richard Hill Exec of Adam Parrott. Case. …The following jury sworn, to wit,…Lewis Shepard

Note: Thomas Robinson Sr., died circa 1782 as his will was recorded in June court of 1782. He lists wife; daughters: Easter, Sarah, Gemina, Pyerce; sons:Thomas (gets land adj. John Anthony and John Robinson), John, Mark & Alexander. The above case against Lewis Shapard appears to have been brought by Thomas Robinson, Jr. Very little information has been found on him. In 1784 tax records of Caswell County a Thomas Robinson is listed in St. David District, in 1798 a T.R. is listed Caswell District with no land. Most interesting is in 1800, there is a listing in Richmond District “James Robinson for Thomas Robinson orphans 400 acres” and in CC probate records in 1802 Solomon Graves is bound as the administrator of Thomas Robinson, deceased. This seems to suggest that Thomas Robinson, Jr. passed away in 1800 shortly after the above lawsuit.   

Note: “assume” legally means, “to take over the liability of a debt on a promissory note, often done by the buyer of real property which has secured debt upon it. i.e. Mr. Seller had debt on his property due the original owner and sells it to Mr. Buyer, who pays the profit of the sale to Mr. Seller and takes over the outstanding debt owed to the original owner. Usually the original owner must agree to the assumption.

“Lewis Shippard” is listed in the Richmond District with 400 acres, one white pole and 4 black poles.

Note: This is in err as he was residing in St. Davids District with his 400 acres, yet may have been taxed when visiting Richmond District.  Anderson Williams was in St. Davids District with 410 acres, 1 white pole, 3 black poles and no stud horses.

34.   1801 (Deed Book M, p. 151). William Gooch, Sr. to son Thomas Gooch 237acres land in Caswell County on the waters of South Fork of Country Line Creek be part of land upon which I now live. Beginning at a beech by the creek William Gooch, Jr. corner and runs with his line south 78 chains to post oak in the old line, thence east along said line bounded for Bird 91 ¼ chains to post oak, thence north with Johnsons line 34 ½ chains to post oak, thence new line bounded for John Gooch 47 chains north 21 degrees west to red bud, wild cherry tree and Spanish oak pointers by a branch, thence down the branch north 60 degrees west 9 ¾ chains to the creek, and up the creek to the beginning.

35.   1801 (Deed Book M, p. 208). William Gooch, Sr. to son David Gooch 72 acres land in Caswell County on the waters of South Fork of County Line Creek being part of larger tract originally estimated at 132 acres yet in actuality is 204 acres. Beginning on the bank of said creek north side at a white oak running thence north 225 poles to black oak on William Kimbroughs line, thence west 74 poles to white oak his corner, thence south James Rices line 34 poles to hickory his corner, thence west his line 90 poles to stake his corner or line, thence south his line 94 poles to post oak in William Jones line thence east his line 70 poles to blackjack his corner, thence south100 poles to white oak on the bank of the creek William Gooch, Jr. corner, thence down the meanderings of the creek to the first station.

36.   1801 (Deed Book M, p. 223). William Gooch Sr., to son John Gooch 300 acres in Caswell County on the waters of the South Fork of Country Line Creek, being part of the land upon which I live. Beginning at white oak corner bounded for David Gooch by the creek on the north side running thence down the creek as it meanders north easterly 17 chains to the mouth of a branch, thence up the branch south 60 degrees east 9 ½ chains to red bud, wild cherry tree and Spanish oak pointers by said branch, thence south 21 degrees east 47 chains to post oak corner of the tract bounded for Isaac Johnston, thence along said east 18 chains to post oak, thence west to and with a line bounded for Nathaniel Gooch 26 ½ chains to blackjack, thence with his line north 28 ½ chains to white oak, thence his line west 7 ½ chains to ash in the fork of a branch, then down the branch and cross the creek to a hickory on the bank 6 ½ chains to a pine in David Gooch line, thence along his line south 33 ¾ chains to beginning.

37.   1801 (Deed Book M, p. 196). Richard Estes to Alexander Kerr, 225 acres on waters of South Fork Country Line Creek. Beginning at dogwood by creek running north 4 Ch 50 L to post oak, thence west 31 Ch 25 L to pointers, thence south 39 Ch 65 L to pointers, thence east with Nathaniel Rice line 59 Ch 20 L to pointers, thence north with Richard Estes line 45 Ch to small ash and pointers by the creek, thence up the creek as it meanders with James Yancy line to beginning.

38.   1801 (Deed Book M, p. 56). Richard Estes to Joseph Chandler, 25 acres land on waters of South Fork of Country Line Creek. Beginning at walnut tree by creek a corner of the old tract and running south with said line to and with William Gooch line 17 Ch to post oak, thence with said line west 14 Ch 70 L to a small white oak in said line, thence north a new line crossing  the creek 17 Ch to black gum and pointers in Lewis Shapard line, thence east with his line and said Chandler 14 Ch 70 L to beginning.

Note: Richard Estes appears to have predeceased his wife Sarah by a few years. She died circa 1811. Bartlett Estes was the administrator of their estates.

Note: Joseph Chandler (c. 1740-1805) born in Virginia, migrated to Granville County,c. 1762. He had four daughters who married John Pinson, William Penson, William Mitchell and George Stovall. Susannah Chandler (1768-1854) married George Stovall (1768-1847) in 1790. In Caswell County Wills, Inventories and Settlements book E, Joseph Chandler assignes George Stovall and his son William Chandler as his attorneys. In his will, Joseph Chandler states that there is a spring on his land that he made use of and one that George Stovall formerly used.

Beginning at turkey oak William Gooch corner and running thence east with his line 14 Ch 63 L to small white oak, thence south a new line 20 ½ Ch to post oak on Nathan Slades line, thence west with his line 14 Ch 63 L to black jack, thence north with Richard Estes own line 20 ½ Ch to beginning.

40.   1801 (Deed Book N, p. 31) State of North Carolina to Luke Pendergast 38 ½ acres on Country Line Creek. Beginning at Spanish oak running north 37 ½ Ch to white oak, thence west along Martin line 11 Ch to pine, thence southerly along Browns (Browning) line formerly Sawyer 37 ½ Ch to white oak, thence east with Chandlers line 9 ½ Ch to beginning.

41.   January 10, 1801 (Civil Action Papers, Caswell County,1801-1805)

Know all men by these presents that we Nathan Williams & William Muzzall are held and firmly bound unto Lewis Sheppard in the just  and full sum of twenty five pounds to be paid to the said Lewis Sheppard his heirs executors and administrators to the which payment is well and truly to be made we bind ourselves our heirs executors and administrators jointly and severally and firmly by these presents sealed with our seals and dated the 10^th day of January A. Dom. 1801.

                The condition of the above obligation is such that whereas the above bounded Nathan Williams hath obtained a writ against the body of Lewis Sheppard if therefore the above bounded Nathan Williams shall well and truly prosecute his said suite with effect or in case he fail therein that he shall well and truly pay all costs and damages that shall be awarded thereon – then the above obligation shall be void otherwise to remain in full force and virtue. 42.   January 13, 1801 (Civil Action Papers, Caswell County,1801-1805)

Know by all men these presents that we William Smith and Elisha Evans are held and firmly bound unto Lewis Sheppard in the full sum of fifty pounds to be paid to the said Lewis his heirs and assignees to which payment is well and truly to be made we bind ourselves our heirs executors and administrators jointly and severally and firmly by these presents sealed with our seals and dated the 13^th January A. Dom. 1801. Note: Joseph Chandler (1739-1805) was born in Goochland Co., Virginia, and was the son of Joseph Chandler. Migrated to Caswell County, NC. Married Sarah Tatum ca. 1730. They had 10 children. Joseph died in Caswell Co. in 1805. His son Joseph (1769-1853) married Elizabeth Stovall ca. 1784 (George Stovall had land next to Joseph – see above). His son William (b. 1779) was given some of his land in Caswell Co. His daughters married John Pinson, William Pinson, George Stovall and William Mitchell.

He mentioned to said Samuel Williams about the right of a certain Negro woman named Hanna that his son Anderson Williams had in his possession and was about to sell the said Negro and Samuel Williams said that he give the Negro to his son Anderson Williams and saith that he had no objection to his selling her. Note: Bench Planes are hand held wood working tools used to flatten and smooth wood via shaving. Mouldng Planes were made of hardwood with a specially shaped iron chisel inside. They were scrapped along wood to carve it for moulding for furniture, window and ceiling borders, etc. A gimlet is a tool for drilling holes in wood. It is a long screw shaped drill with a cross handle at the end used for twisting the drill. A gouge is a small chistle with a curved or angled blade used for woodworking. Curry Comb is a rounded brush with short “teeth” on one side and a strap for the hand on the other, used for daily grooming of horses. Bay Mare is a female horse with reddish-brown body color with a black mane, ear edges and lower legs

Lewis Shapard is listed as holding 300 acres of land in St. David District with one white pole and 6 black poles.

Anderson Williams was in St. Davids District with 352 acres, 1 white pole, 3 black poles and no stud horses.

Note: at this time Caswell County had four districts: Richmond District was located in the northeast corner and included Caswell Court House (now Yancyville) which was the county seat, Glouchester District was located in the southeast corner, Caswell District was located in the northwest corner, and St. David District was located in the southwest corner.

Note: Yancyville was originally named Caswell Court House. It was not established along a waterway and was very slow to grow. In 1810 it had one store, one hatter, 2 taverns and 15 homes. Hillsboro in Orange County was the regional political center. The closest commercial centers were Richmond and Petersburg in Virginia. Caswell Court House was renamed Yancyville when it was incorporated and boomed in the 1830s.

Lewis Shapard’s mother Mary Booker Shapard died in Granville County, North Carolina before June of 1804. She was 57 years of age.

Note: After this date her husband became erratic in his finances and seemed to lose his will to thrive. Two grandchildren were born both honoring Mary Booker Shapard, presumably due to her death. Mary Booker Royster (daughter of Elizabeth and Francis Royster) was born in June 1804 and Mary Booker Shapard (daughter of James and Frances Shapard) was born in 1804 in Caswell County, North Carolina.

Note: James Yancey, Esq. (c. 1768-1829) married Lucy Kerr (d/o Alexander Kerr & Elizabeth Rice) in 1794. She died w/o children. He then married Zilpah Johnston in 1811. She was the daughter of Dr. Lancelot Johnston and Zeriah Rice (d/o Thomas Rice). Dr. Johnston was a surgeon during the Rev. War. He operated a store and ordinary on his land. James Yancey was constable in Caswell County in 1788. He served in the legislature (General Assembly of North Carolina) in 1798, 1801-03,1807-08, 1811 & 1822. Helped establish the first academy in Caswell County as trustee (Caswell Academy). In 1804, he was named guardian for the children of his deceased brother Thomas. He was a Justice (Court of Pleas and Quarter Sessions)for Caswell County from 1808-1829. The name of Yanceyville was in his honor as he died in 1829 after he had reached an agreement with the Graves brothers on acquiring extra land around the courthouse, for the establishment of a much needed larger courthouse. The new courthouse was completed after his death in 1833.  

James Yancey’s youngest sibling was Barlett Yancey, Jr. (1785-1828) and son of Bartlett Yancey, Sr. (d. 1784). Bartlett Yancey Jr. begin teaching school at 15 years of age at the Courthouse. He became well educated at University of NC and became a lawyer in 1807. He was elected to the US House of Representatives in 1812 and served until 1817. He served as a State Senator from 1817-1827. He married Ann Graves in 1808.

Witnesseth that Nathaniel Rice deceased in his life time did for valuable consideration receive, bargain, sell and deliver unto the said Anderson Williams a certain tract of parcel of land containing 440 acres on the waters of South Fork of Country Line Creek adjoining the lines of Henry Williams deceased, Nathaniel Rice deceased, William Slade and others, it being part of the tract of land containing 640 acres granted by said state to John Rice, SR., deceased on March 3, 1779, and the said Nathaniel Rice dying before he had made a deed of conveyance to Anderson Williams [so heirs contracted a receipt to honor the conveyance].

Note: Frances (Brooks) Shapard’s mother died in late 1807 as will was probated in January 1808. It appears that after the death of her mother, Frances and James moved to Orange County North Carolina circa 1808. Note that in 1806, Frances and James Shapard had three daughters.

                This Indenture made this tenth day of March in the year of our Lord one thousand eight hundred and six between Anderson Williams of the County of Caswell and Sate of North Carolina of the one part and Lewis Shapard of the County and state aforesaid of the other part witnesseth that for and in consideration of the sum of two hundred and twenty dollars to him in hand paid by the said Lewis Shapard to the said Anderson Williams the receipt whereof he doth hereby acknowledge that he the said Anderson Williams hath bargained and sold and by these presents doth bargain, sell and deliver unto the said Lewis Shapard his heirs or assigns forever a certain tract or parcel of land situate lying and being in the County of Caswell aforesaid on the waters of South Fork of Country Line Creek, beginning at a blackjack on Henry William’s line there north sixty seven degrees east twenty four chains and fifty links by land claimed by Alexander Kerr now Thomas Johnstons crossing a branch to a stake there north to Nathaniel Rice’s corner black oak by a path thence east with said Nathaniel Rice’s line now Archibald Rice’s thirty eight chains to a stake at corner of said Archibalds thence with said Archibalds line south eleven degrees east thirty four chains to Leonard Browns now Thomas Browns corner black oak thence south with Browns line twenty five chains to a redbud thence west sixty seven chains and ninety links to the first station containing lay estimation three hundred and eighty two acres and one quarter of an acre of land be the same more or less (it being part of a tract of land granted by the State to John Rice Sen. deceased, containing 640 acres bearing the date 1779 of which the above names Nathaniel Rice had 200 acres conveyed by said John Rice Sen. and said Anderson conveyed 57 ¾ acres of said original grant of 640 acres to Archibald Rice).  To have and to hold the said tract or parcel of land with all the appurtenances thereunto belonging or in any wise appertaining unto the said Lewis Shapard his heirs and assigns forever, and the said Anderson Williams for himself and his heirs doth further contend and agree to and with the said Lewis Shapard his heirs executors adm. or assigns to warrant and forever defend a good and lawful right and title in for simple against himself his heirs or any other person or persons whatsoever unto him the said Lewis Shapard his executors, adm., or assigns forever free and clear from all incumberances except thirty acres thereof, which Susannah Rice widow of John Rice Sen., deceased. *Note: Anderson Williams (b. 1767) was Lewis Shapard’s brother-in-law through the marriage to his sister, Mildred Shepard, on December 18, 1786 in Cumberland County, Virginia. Anderson was the grandson of Thomas Williams who was born in Wales in 1712 and married Susannah Anderson and lived in Cumberland County Virginia.from the 1760s until his death around 1794. William had two sons; Charles born about 1740 and died in 1805 in Pittsylvanna Co. VA; and Samuel born September 18, 1744 and died around October 1823 in Cumberland County VA.He married Susannah Ligon in 1766 and then married Mary Wright. Samuel and Susanna had 10 children: Anderson, William b. 1771, John b.c1773, Charles b. c1775, Reuben b. c1777, Polly b. c1779, Samuel, b. 1781, Robert b. 1786, Joseph b. 1789. Anderson Williams and Mildred moved from Cumberland County, Virginia to Caswell County, North Carolina. Anderson and Mildred moved to Campbell County, Virginia in 1806, where they settled   He is listed in 1810 in Caswell County Census. He is listed in the  Campbell County, Virginia census of 1830. His occupation was a ‘Wheelwright’. Mildred died between 1840 and 1850 as she is not listed on the 1850 census of Campbell County, but Anderson is listed as living with his daughter Susanna Taylor. In 1860 Anderson is living with his daughter Elizabeth Garrett in Campbell County Virginia. Anderson died after 1860. Anderson and Mildred had 7 children: Elizabeth b. c1786 and married Joesph Garrett, Susannah “Suckey” b. c1794 and married John Taylor, Nancy married George Fox, Mary b. c1804 married James Collins, Daughter b. c1806 d. c 1810, Daughter b. c1808 d. c. 1810, and Anderson b. c 1810 married Martha Finch in Campbell Co., Virginia.

Note: In the probate records of Alexander Kerr (Caswell County NC) it states on page 3 & 4; “Jurors met on 24^th of March 1818, proceeded to begin & lay of a road beginning near Stony Creek Bridge on the road leading by John Bashers and Benjamin Leas and run it as follows… Beginning at a ___ tree leading on through and old ___ plantation, the property of the heirs of Alexander Kerr deceased along the marked line between Mason Stacey of their heirs of said home of Jamie Lawyers breaking there prong of Honey Creek just below William Sawyers up the creek and ___ a northern prong of Honey Creek a little below Thomas Fosters old mill on between said Thomas Fosters of Buford Pleasants then along an old road to Nathan Williams home, through James Shapards old field as it is marked along an old used way until it intersects with the Caswell Road near John Boldens…. (Edmund Rice had a Smith Shop nearby).

Note: Anderson Birk was the husband (married in November 1804) of Nancy Rice, daughter of Nathaniel Rice. This is the same land that Lewis purchased of Anderson Williams in March of 1806. Wylie Yancey married Susannah Rice, daughter of Nathaniel Rice. Anderson Birk was the son of James Birk, Sr. Anderson first appears in Caswell County deeds in 1805 and is last mentioned in 1830, afterwhich he moved to Stewart County, Tennessee.

The condition of the above obligation is such that if the above bounden James Shapard shall well and truly make his personal appearance at our next County Court of Pleas and quarter sessions to be held for the County of Caswell on the last Monday of April next then and there to answer George Oldham of a plea that he rendered unto him seventy five dollars of the value of thirty seven pounds ten shillings currnet money which he detains to his damage twenty pounds and then and there to stand to abide by and perform the judgement of said Court and not depart said Court without leave then the above obligation to be void or remain in full force and virtue.                 This indenture made the 5^th day of March anno Dommini 1807 between Lewis Shapard of Caswell Couny and state of North Carolina of the one part and Thomas Shapard of Granville County and state aforesaid of the other part. Witnesseth that the said Lewis Shapard for and in consideration of the sum of one hundred and ten pounds Virginia money to him in hand paid the receipt whereof he doth hereby acknowledge before the sealing and delivery of these presents hath granted bargained sold and delivered unto said Thomas Shapard one certain tract or parcel of land situate lying and being in the County of Granville and bounded as followeth, beginning Payears and James Yancey’s ccorner thence west to James Yanceys corner white oak thence north on his line to __ Yanceys corner white oak, thence west to Downies corner pine in the crab orchard thence south on Downes line to his corner pointers, thence west on Downes line to Harris’s corner white oak, then south on Harris’s line to a stake in the pon, Harris’s corner, thence east on Harris’s line to a black jack – Harris’s corner in Shapards line, north on Shapards to a red oak Shapards corner east on Shapards line to a red oak Shapards corner in Preyears line thence north on Preyars line to the beginning containing two hundred and seven acres – more or less, together with the titles and previleges, etc. the said Lewis Shapard doth warrant and defend all rites and titles of said land to the said Thos. Note: It is believed that Lewis Shapard joined his brother-in-law James Paine and William Bird Brooks on an excursion to Tennessee in April of 1807 until approx. August. James Paine’s son (Bishop Robert Paine) recorded that his father went to Tennessee in 1807 to scout it out, and finally moved there in 1813, describing the trip. The possibility of Lewis joining his brother-in-law in 1807 is given credence by the fact that he was with all of these men in late March 1807 and he is completely missing in the county records from March until January the following year. The only record of him during this time is the above record in which his name is curiously crossed out, which would make sense if the court was informed he was out of state for an extended time.

135. 1808 (A History of Caswell County North Carolina 1777-1977, pg 154-155)

The people of Caswell County apparently enjoyed politics and often became intensely involved in campaigns. The earliest noted legal machinery for conducting elections in the county was provided in the Session Laws of 1808 in a chapter entitled “An Act to establish four separate Elections in the County of Caswell.” “…that after the passing of this act, there shall be open and held four separate elections in the county of Caswell, that is to say, one in each district, at such places as the commissioners hereinafter named shall appoint and agree upon, which elections shall be held on the second Thursday in August annually…” Commissioners were appointed for each of the four districts into which the county was divided, and they were charged with finding a suitable place to hold elections. The legislature appointed the first set of commissioners:

Gloucester District: Robert Parks, William Muzzall, William Lea, John Hightower, Thomas Turner.

St. David District: Robert Blackwell, Joseph Scott, Malan Stacey, Lewis Sheperd, Jethro Brown.

Caswell District: Dudley Gatewood, Gregory Durham, Josiah Womack, John Cobb, John Green.

Richmond District: Josiah Lamuel, John Burton, Thomas Harrison, Capt. John Lea, John Johnson.

…The commissioners were directed to open the polls at 11am and close them 4 in the afternoon. When the polls closed the commissioners were to count the votes promptly and to prepare a list of people who voted. The information (tally of votes and names of voters) was to be given to the sheriff by 2 pm Friday (next day) and by him to the next session of court. Any person who voted at more than one poll on the same day, upon conviction, would have to forfeit 10 pounds. All elections within the county were held in this manner, even for president and vice president and congress.
